INTRODUCTION

1.1 The Site allows the reservation of apartments/studios and additional services by customers.

1.2 These general terms and conditions of sale (the “General Terms and Conditions of Sale”) are applicable to the reservation of apartments/studios and additional services within the establishments (the “Services”) and are those in force on the date of confirmation of your reservation on the Site. They cancel and replace any General Terms and Conditions of Sale previously put online and/or accepted by the Customer.

1.3 Any reservation on the Site requires consultation and acceptance without reserve or condition of the General Terms and Conditions of Sale. It is recommended to download and/or print the General Terms and Conditions of Sale in order to keep a copy on the day of a reservation, as they are subject to change. Nevertheless, any modification occurring after the confirmation of a reservation cannot be applied to this reservation.

1.4 Acceptance by the Customer of the General Terms and Conditions of Sale and the conditions, in particular the financial conditions, of each reservation made is effected by clicking on “I accept the terms and conditions” or any other similar box proposed on the Site.

1.5 The Customer acknowledges having all the necessary information on the Site, which includes in particular :

the full contact details of the company Location-Aulnoy-lez-Valenciennes, which can be consulted in the “Contact Us” section of the Site,
the main and essential characteristics of the accommodation and additional services offered to customers,
the present General Terms and Conditions, the special conditions applicable to each offer and/or accommodation and/or additional service(s) and the Privacy Policy,
the price of accommodation and additional services offered to customers,
the minimum number of nights that can be booked by a Client,
the terms and means of payment accepted,
the duration of the contract concluded between the customer and the Service Provider.

1.6 The term “Customer(s)” refers to any natural person who places an order on the Site, as a consumer, for private or professional purposes, but not related to the hotel business.

1.7 Being a consumer, the Client benefits from rights that may be challenged in the event that the Services are reserved by him in the exercise of a professional, commercial, industrial, craft or liberal activity.

1.8 Only Customers (i) who have reached the age of majority (eighteen in most countries) and (ii) who have the legal capacity to enter into contracts are authorised to order Services on the Site.

1.9 The information provided by the Site is presented in French, as well as in several foreign languages.

SUBJECT

2.1 The General Terms and Conditions of Sale define the terms and conditions applicable to online reservations on the Service Site.

2.2 The General Terms and Conditions of Sale do not govern the offer, reservation or order of Services offered by entities other than LOCATION-AULNOY-LEZ-VALENCIENNES and on other websites and/or mobile applications. We recommend that before confirming any order for Services through third party websites or mobile applications, you check their general terms and conditions of sale, since LOCATION-AULNOY-LEZ-VALENCIENNES cannot be held responsible for the provision of Services offered by third parties.

2.4 The General Terms and Conditions of Sale are applicable to all stages of the reservation of Services by the Customer and to the follow-up of his reservation.

BOOKING

3.1 The Site offers an online booking process for apartments and/or studios and additional services.

3.2 Hosting offers presented on the Site are accompanied by an information sheet including :

if applicable, the type of commercial offer applicable (for example: “Book now and pay less”, “Last minute promotion -10%”, “Flexible rate”, “Room and breakfast” …),
a description of the apartment/studio concerned,
ancillary services included in the offer,
household services
the cancellation and modification conditions applicable to the reservation,
where applicable, the special conditions of sale applicable,
terms and conditions of payment,
the General Terms and Conditions of Sale.

3.3 The Site occasionally proposes commercial offers that are only accessible on the Site, to the exclusion of any other third party site, such as in particular temporary offers called “Best guaranteed rate” or “Special rate”. Where applicable, the Customer is invited to consult the special conditions applicable to these offers, which are brought to his attention at the time of booking. These commercial offers may be modified at any time by LOCATION-AULNOY-LEZ-VALENCIENNES, which is only contractually bound by the reservations validated by the Client and cannot be held liable for the modification or withdrawal of a commercial offer on the Site.

3.4 The Client selects the Services offered on the Site. He is solely responsible for the choice of the Services and their suitability to his needs, so that LOCATION-AULNOY-LEZ-VALENCIENNES may not be held liable in this respect.

3.5 The Customer may reserve one or more apartments/studios on the Site. For any other request for services not appearing on the Site, we invite you to contact LOCATION-AULNOY-LEZ-VALENCIENNES directly.

3.6 The reservation is deemed to be accepted by the Customer at the end of the reservation process.

3.7 The Client certifies the truthfulness and accuracy of the information provided when booking Services. LOCATION-AULNOY-LEZ-VALENCIENNES reserves the right not to follow up on any reservation made by a person who makes fraudulent use of the Site or who does not comply with these General Terms and Conditions of Sale.

BOOKING PROCESS

4.1 Reservations are made by the Customer by means of a dematerialised reservation form accessible on the Site.

The minimum number of overnight stays is set at 3.

A deposit of 400€ will be requested from the customer. This deposit will be presented by the customer in the form of a cheque made out to Société SATA on arrival.

4.2 When making a reservation, the Client must provide a certain number of mandatory data, including certain personal data necessary for the processing of the reservation by LOCATION-AULNOY-LEZ-VALENCIENNES, which reserves the right to refuse any reservation in the absence of this data or because of its erroneous nature.

4.3 The booking procedure on the Site includes the following steps:

Step 1: Selection on the home page of the Site https://location-aulnoy-lez-valenciennes.rosemma.group, of the date of arrival,

Step 2: Opening of a secure page indicating the offers available for the selected accommodation and the date indicated, and offering the Client the possibility to specify or modify any of the choices made (arrival and departure dates, number of people…),

Step 3: Consultation and selection of an offer,

Step 4: Selection, if necessary, of one or more Additional Services,

Step 5: Verification of the details of the booking, its total price and the applicable conditions and possible modification of the choices made,

Step 6: Provision of contact details by the Customer,

Step 7: Consultation and acceptance of the General Terms and Conditions of Sale, the Privacy Policy and, where applicable, the special terms and conditions of sale before the Customer validates the reservation,

Step 8: Validation of the reservation by the Client.

CONFIRMATION OF RESERVATION

5.1 The Site acknowledges receipt of the reservation made by the Client by sending an e-mail containing (i) the corresponding reservation number, (ii) the summary of the reservation and in particular the Services reserved, the price of the Services, the terms and conditions of sale applicable to the selected price, accepted by the Client, (iii) the General Terms and Conditions of Sale, where applicable, information relating to after-sales service and the contact address to which complaints may be submitted.

5.2 The reservation is deemed to be firm and definitive upon receipt of this reservation confirmation e-mail sent by LOCATION-AULNOY-LEZ-VALENCIENNES to the Client.

5.3 The duration of the contract concluded between the Client and Location-Auloy-lez-Valenciennes corresponds to the duration of the Accommodation Service provided for in the reservation.

CANCELLATION OR MODIFICATION OF A RESERVATION BY THE CUSTOMER

6.1 Pursuant to Article L.121-21-8 of the French Consumer Code, the Services offered on the Site do not allow the exercise of the right of withdrawal provided for in Articles L.121-21 et seq. of the French Consumer Code with regard to distance selling contracts.

6.2 Reservations with prepayment cannot be modified and/or cancelled. The sums paid in advance may not be reimbursed, which will be indicated in the conditions of sale of the tariff brought to the Customer’s attention and accepted by him.

6.3 Where cancellation of a booking is possible, a specific “cancel order” link is available on the home page of the Site, allowing you to cancel a booking by entering the e-mail address provided at the time of booking and the booking number indicated in the booking confirmation e-mail.

6.4 If commercial offers present on the Site include special conditions on the cancellation and modification of the reservation, these are detailed in their Special Conditions appearing in the description sheet of the offer.

6.5 Unless different special conditions apply, the cancellation or modification of a reservation is not possible under any circumstances.

NO-SHOW AND INTERRUPTION OF THE STAY

7.1 Any reservation made on the Site provides for an arrival time at 14:00 and a departure time at 12:00. The Customer must arrive at the apartment before 6:00 pm or inform the Guest in case of late arrival. If the Client does not show up at the Apartment after 18:00, one night’s penalty will be automatically debited from the Client’s credit card indicated at the time of booking, except in the case of prepayment of the reservation on the Site.

7.2 Any interruption of the stay before the departure date provided for in the reservation will result in the payment of the entire agreed price.

PRICE OF SERVICES

8.1 The price of the Services is indicated on the Site before the reservation on the offer description sheet, as well as during the reservation.

8.2 The rates indicated are per apartment/studio, for the number of people indicated, depending on the apartment/studio and the period selected, and include only the Services strictly mentioned in the reservation.

8.3 The price of each Service is indicated inclusive of all taxes (including VAT).

8.4 The Euro is the commercial currency of the booking, payment must therefore be made in this currency.

8.5 The prices mentioned on the Site may be modified at any time by LOCATION-AULNOY-LEZ-VALENCIENNES, without prior mention or notice. Only the price indicated in the confirmation of the reservation is contractual.

PAYMENT OF PRICE

9.1 Our site offers offers for which only online payment will be proposed to you. WARNING, no modification, cancellation or refund will be possible, the totality of the stay will be debited from your credit card. In application of article L121-21-8 of the consumer code, the right of withdrawal provided for in article L121.21 is not applicable. Payment on the site is made by credit card (Visa, Mastercard) and via a secure payment system. You will be asked for your credit card number, the cryptogram on the back of your card and its expiry date. Any payment that would be irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer’s expense, without prejudice to any civil or criminal action against him. All orders are carried out in the following stages: you indicate the criteria of your request, we propose one or more offers, you choose the offer that suits you, the summary of your order is displayed (details and total price), you check and if necessary correct your order, you finally validate your order after validating our general conditions of sale, you proceed to online payment in secure mode, a detailed confirmation of your order is displayed on the screen (to be printed and kept), you will receive within a maximum of one hour a detailed confirmation of your order to the e-mail address you have given us. The booked stay is only definitively acquired after the effective debit of your credit card and the reception of our confirmation. The confirmation is deemed to represent the agreement of the parties.

STAY AT THE APARTMENT/STUDIO

10.1 Identification will be requested from the customer upon arrival on the premises.

10.2 Pets are not allowed in the apartments/studio.

10.3 During the stay, the Client undertakes to use the apartment/studio he occupies in a reasonable and responsible manner. The Guest may ask the Client to leave the apartment/studio without any compensation being paid and to pay the full amount of the booked Service, in particular in the event of :

behaviour contrary to morality or public order,
any damage, degradation, act of vandalism occurring by his own fault or that of his employees or persons in his care, during the occupation of the premises, on any movable or immovable property, furniture, decoration or any other nature present in the apartment/studio.

In addition, the Client shall be required to reimburse the full amount of the damage caused by his acts, LOCATION-AULNOY-LEZ-VALENCIENNES having all the powers and being able to take any useful action to obtain compensation for the damage suffered.

10.4 LOCATION-AULNOY-LEZ-VALENCIENNES provides Customers with wifi internet access in certain apartments/studios.

The Customer undertakes to ensure that the computer resources made available to him/her are not used for fraudulent or illegal purposes, and in particular in order to commit any act of infringement of third party rights and/or illegal downloading of works protected by copyright or related rights, punishable under Article L.335-2 of the French Intellectual Property Code.

DISLOCATION – FORCE MAJEURE

11.1 If the apartment/studio reserved by the Customer is unavailable, LOCATION-AULNOY-LEZ-VALENCIENNES reserves the right to have the Customer stay totally or partially in an apartment/studio of an equivalent or higher category offering Services of the same nature. The transfer will be entirely at the expense of LOCATION-AULNOY-LEZ-VALENCIENNES, without any additional costs being requested from the Client.

11.2 LOCATION-AULNOY-LEZ-VALENCIENNES shall be released from any liability for the non-fulfilment of its obligations in the event of an event of force majeure, for the duration of the event of force majeure, and undertakes to make all efforts reasonably necessary to limit its effects.

11.3 For the application of this Article, force majeure is understood as any event or fact that the parties could not reasonably foresee and control at the time of the reservation because of its external, unforeseeable and irresistible nature to the parties. Are thus notably considered as cases of force majeure, in addition to those retained by the French courts and tribunals, total or partial strikes, internal or external to the apartments/studios, terrorism, wars or uprisings, bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, breakdown of the computer system paralysing the normal pursuit of its activity by a Party.

PRIVATE DATA

12.1 In application of law n°2018 – 493 of 20 June 2018 relating to the protection of personal data and of the General Data Protection Regulation n°2016/679 (RGPD), the Customer is informed that the information provided at the time of booking has been subject to personal data processing for the purposes of managing bookings and Customers, invoicing and payment requirements, as well as for commercial prospecting purposes.

12.2 The Customer is also informed that the accommodation has a video surveillance system in the common areas of the building for the safety of persons and property.

12.3 The Client has a right of access, rectification, portability and deletion of personal data concerning him, which he may exercise by contacting the services of LOCATION-AULNOY-LEZ-VALENCIENNES by writing to the following e-mail address: societe.sata@gmail.com

12.4 The Client may obtain information on the way in which LOCATION-AULNOY-LEZ-VALENCIENNES handles its personal data by consulting the Privacy Policy or by sending a request to the following e-mail address: societe.sata@gmail.com or to the address of our registered office: 3 Rue Henri Durre, 59300 Aulnoy lez Valenciennes France.

APPLICABLE LAW – MEDIATION – JURISDICTION

13.1 These General Terms and Conditions of Sale are governed by French law.

13.2 All complaints relating to the non-performance or poor performance of the Services by a service provider must be reported by the Client, under penalty of foreclosure, by registered letter with acknowledgement of receipt, within fifteen days of the date of departure from the apartment /studio at :

LOCATION-AULNOY-LEZ-VALENCIENNES will endeavour to deal with this claim in the best possible way and to reach a resolution of the dispute in accordance with the interests of both parties.

13.3 In the absence of an amicable settlement of the dispute, any difficulty relating to the interpretation, execution and validity of these General Terms and Conditions of Sale shall be subject to the exclusive jurisdiction of the competent courts of Valenciennes.

GENERAL PROVISIONS

14.1 The General Terms and Conditions of Sale are amended on a regular basis, in particular in consideration of normative changes. The new General Terms and Conditions of Sale shall apply on the date of their publication on the Site.

14.2 The General Terms and Conditions of Sale, including the Privacy Policy, the General Terms and Conditions of Use of the Site and, where applicable, the special conditions specific to certain offers, constitute the entirety of the contract concluded between the Client and LOCATION-AULNOY-LEZ-VALENCIENNES concerning his reservation on the Site and cancel all previous General Terms and Conditions of Sale.

14.3 In the event that one of the stipulations of these General Terms and Conditions of Sale is declared null and void in whole or in part, for whatever reason, the other stipulations shall remain in force.
